Con base en el sistema de mérito establecido para la promoción del personal inscrito en la carrera, la Escuela Judicial elaborará listas de elegibles para la provisión de los empleos vacantes. En el evento de que por cualquier circunstancia no pueda proveer la respectiva vacante por el sistema de ascenso, deberá efectuarse concurso abierto, en el cual podrán participar personas no vinculadas a la administración de justicia.
