Los testigos que se hallen a menos de cinco leguas del lugar donde resida el Congreso, darán sus declaraciones ante el Senado o su Presidente, si así lo dispusiere aquél cuando se haya reservado la instrucción del proceso, o ante la Comisión instructora, cuando se la haya cometido dicha instrucción. Los testigos que se hallen a cinco o más leguas de distancia, lo mismo que los impedidos, declararán ante la autoridad a quien cometa el Senado o la comisión instructora esta diligencia.
