° La transformación a que se refiere el artículo anterior tendrá lugar a partir de la fecha en que empiece a operar la sociedad Mineralco S. A., e implica la asunción por ésta del patrimonio de Ecominas, es decir, de todos sus activos y pasivos. En virtud de que la transformación se entiende desde el punto de vista institucional, como persona jurídica y patrimonialmente, no habrá solución alguna de continuidad ni en la existencia, ni en las actividades, ni en las relaciones de todo orden con terceros. Inmediatamente empiece a operar Mineralco S. A. se entenderá extinguida la Empresa Colombiana de Minas, Ecominas.
