De conformidad con el artículo 3º de la Ley 40 de 1905 , el Estado se reserva el derecho de vender las esmeraldas que se produzcan en el país. El Gobierno dictará los decretos necesarios para regular la talla y el comercio de las esmeraldas, estableciendo las sanciones y medidas de fiscalización que al respecto considere pertinentes.
