ARTICULO 135. Peculado por error ajeno. El empleado oficial que se apropie o retenga, en provecho suyo o de un tercero, de bienes que por error ajeno hubiere recibido, incurrirá en prisión de uno (1) a tres (3) años, multa de un mil a cincuenta mil pesos e interdicción de derechos y funciones públicas de uno (1) a tres (3) años. Cuando no hubiere apropiación ni retención, sino uso indebido, la pena se reducirá en la mitad.
