El artículo 45 del Decreto 2584 de 1993 quedará así: Artículo 45 . Funcionario investigador. El cargo de funcionario investigador podrá recaer en un Oficial, miembro del Nivel Ejecutivo a partir del grado de Subintendente, Suboficial, Auditor de Guerra y personal no uniformado que ostente título de abogado.

Parágrafo

Dentro de la jerarquía policial no podrá designarse como funcionario investigador a persona de menor antiguedad o grado de quien es objeto de investigación.
