Llegados el día y la hora señalados para la comparecencia de las partes, si el demandante no comparece sin excusa legítima, se le tiene por desistido del juicio, condenándolo en costas.

Si es el demandado quien no comparece, se sigue el juicio sin nueva citación de él.
