PROHIBICIÓN DEL PAGO DOBLE DE SUBSIDIO FAMILIAR . En ningún caso habrá lugar al reconocimiento doble de subsidio familiar. Cuando el cónyuge del Agente preste sus servicios en el Ministerio de Defensa o en la Policía Nacional, el subsidio se reconocerá en cabeza de aquel que perciba mayor asignación básica, si esta fuere igual, recibirá el subsidio quien acredite mayor tiempo de servicio.

Parágrafo

Los Agentes de la Policía Nacional cuyo cónyuge preste servicios en otra entidad oficial, para tener derecho al subsidio familiar deberán acreditar que su cónyuge ha renunciado a dicha prestación en la entidad donde trabaja, mediante certificación expedida por esta última.
