° El artículo 991 del Código de Comercio, quedará así: Artículo 991. Cuando la empresa de servicio público no sea propietaria o arrendataria del vehículo en que se efectúa el transporte, o no lo tenga a otro título el control efectivo de dicho vehículo, el propietario de éste, la empresa que contrate y la que conduzca, responderán solidariamente del cumplimiento de las obligaciones que surjan del contrato de transporte. La empresa tiene el control efectivo del vehículo cuando lo administra con facultad de utilizarlo y designar el personal que lo opera, directamente y sin intervención del propietario.
