ARTICULO 434 . Trámite . Recibida la solicitud, el juez decretará inmediatamente una inspección a las diligencias que pudieren existir en el asunto que dio lugar a la petición, que deberá practicarse a más tardar dentro de las doce horas siguientes. En ningún caso se someterá a reparto la petición y conocerá de ella privativamente el juez ante quien se formule. El juez no podrá ser recusado en ningún caso.
