Los nombramientos de los Jueces Superiores y de Circuito, tanto principales como suplentes, corresponden a los Tribunales Superiores en Sala de acuerdo. También corresponde a los Tribunales declarar la vacante en los casos de los artículos 5,° y 6.° del Libro l.° del Código Judicial.

Parágrafo

Los Suplentes de los Jueces no necesitan acreditar los requisitos de que trata el artículo 2.° de la Ley 39 de 1898 , para posesionarse y entrar en el ejercicio de sus funciones.
