El funcionario o empleado público que haga conocer pública o privadamente documentos o noticias que deba mantener en secreto o reserva, será privado de su empleo y se le aplicará multa de diez a quinientos pesos si no mediare perjuicio. Si de tal hecho resultare perjuicio, en vez de multa se aplicará arresto de diez días a dos años.

Si la violación del secreto o reserva tiene lugar por culpa del funcionario o empleado, la multa se reducirá de una tercera parte a la mitad.
