Artículo segundo. Habrá lugar a conmutación cuando una empresa nacional o extranjera con pensiones de jubilación pendientes, entre el proceso de cierre o liquidación, o en notable estado de descapitalización, disminución de actividades o desmantelamiento que pueda hacer nugatorio el derecho de jubilación de los trabajadores.
