La sentencia debe estar fundada en las pruebas del proceso, y no podrá recaer sino sobre los cargos deducidos en el auto de enjuiciamiento, debiendo citarse en ella las disposiciones legales aplicables.

Dicha sentencia es apelable en el acto de las notificaciones o dentro de las veinticuatro horas siguientes, ante el Comandante de la Unidad superior a que pertenezca el reo. Si la sentencia no fuere apelada, se pasará en consulta a dicho Comandante.
