Se castigará con reclusión de cinco días a veinte meses a quien denuncie ante la autoridad una infracción punible, sabiendo que no se ha cometido, o a quien simule pruebas o indicios de ella que puedan servir de motivo a una instrucción judicial.

Incurrirá en la misma pena quien declare falsamente ante la autoridad judicial, que ha cometido o ayudado a cometer una infracción, salvo que trate con ello de salvar a un pariente próximo.
