. Derogado por el artículo 242, Ley 222 de 1995 . Se considerarán quiebras y deberán tramitarse como tales:

Toda oferta de cesión de bienes por parte de comerciantes, y

Los procesos ejecutivos que se adelanten contra este, por obligaciones mercantiles, cuando se haya admitido tercería o decretado acumulación, siempre que los bienes embargados parezcan insuficientes para el pago y lo solicite al deudor o cualquier acreedor.

Si el juez ante quien se presenta la oferta o que conoce de la ejecución no fuere competente para tramitar la quiebra, enviará el expediente a quien lo sea.
