Art. 5.° Cada Seccion de los Resguardos constará de un Jefe y de los Ayudantes, Cabos, Guardas, Vigías, Prácticos, Pilotos y Remeros que el Poder Ejecutivo les asigne. Los Guardas serán nombrados y removidos, respectivamente, por los Administradores de las Aduanas y por los Administradores principales de Hacienda nacional en Panamá y Tunja. Los Vigías, Prácticos, Patrones y Remeros serán nombrados por los Jefes de las respectivas Secciones, y podrán ser removidos por el Jefe de la Oficina fiscal de quien dependa la Seccion. Los Pilotos y los Remeros serán considerados como Guardas y empleados en este servicio cuando no estén ocupados en sus especiales trabajos.
