No puede oponerse compensación a la demanda de restitución de una cosa de que su dueño ha sido injustamente despojado, ni a la demanda de restitución de un depósito, o de un comodato, aun cuando perdida la cosa, sólo subsista la obligación de pagarla en dinero.

Tampoco podrá oponerse compensación a la demanda de indemnización, por un acto de violencia o fraude, ni a la demanda de alimentos no embargables.
