No son tachables de lleno pero si sospechosos:

1ºLos parientes dentro de cuarto grado de consanguinidad o segundo de afinidad, menos los que indican los numerales 1º y 2º del artículo 631;

2º Los herederos o legatarios, cuando saben que los son;

3º Los criados y demás personas que dependen especial, inmediata y directamente de otras;

4º El que recibe de otro alimentación gratuitamente;

5º El amigo intimo; y

6º El enemigo declarado pero no mortal.
