Se pondrá provisionalmente en libertad, con caución, al individuo respecto del cual se haya sobreseído o a quien se le haya absuelto en primera instancia, mientras se surte la apelación o consulta a que hubiere lugar, cualquiera que sea el delito porque se proceda.
