Art. 87 . Los Jueces y Magistrados a quienes corresponda conocer del incidente que habla los artículos 758 y 760 del código judicial, antes de declarar separado al magistrado o juez impedido resolverán sobre la legalidad del impedimento mismo, y tendrán en consideración si conforme a la ley ha debido manifestarse el impedimento por el juez, o alegarse por las partes.
