El guardador puede exigir que el demandante particular asegure con una caución los perjuicios que se sigan al pupilo, por el seguimiento del juicio si el demandado es absuelto.

Si esta caución no se presta dentro del término que el Juez señale, se revoca el nombramiento del guardador interino, salvo que el Juez considere que, no obstante esa falta, debe mantenerse la providencia en bien del pupilo.
