El funcionario, empleado público, o encargado de un servicio público, que utilice en provecho propio o ajeno, inventos, descubrimientos científicos o nuevas aplicaciones industriales, que haya conocido por razón de su cargo o servicio, y que deban permanecer en secreto, incurre en una multa de cincuenta a mil pesos y en arresto de dos meses a tres años.
