Si el presunto desaparecido reapareciere o se tuviere noticias ciertas de su existencia, el Comando de Fuerza, de oficio, ordenará reabrir la investigación de carácter administrativo, a fin de establecer una de estas dos situaciones o ambas, si es el caso
a)
La certeza de la reaparición, para lo cual se establecerá su plena identificación por los medios técnicos indicados, y
b)
Identificada la persona, se hará una investigación formal sobre sus actividades durante el tiempo comprendido entre la fecha de su desaparición y la de su reaparición.
Parágrafo
Si en la investigación administrativa se llegare a establecer acciones u omisiones que deben ser investigadas por la Justicia Penal Militar, se tramitará el expediente respectivo, a fin de que se adelante el proceso a que haya lugar.
