Art. 140. Cuando la culpa no sea enteramente del juez, como en el caso de ilegitimidad de la personería de la parte a quien el Juez ha admitido como tal, sin deber a in admitirla, o en cualquier otro caso en que el Juez haya debido advertir la irregularidad en que se incurría, el pago de las costas corresponderá por mitad al Juez y a la parte culpable.
