Los pensionados, tanto civiles como militares tienen el deber de dar cuenta al Ministerio del Tesoro, cuando entren en ejercicio del empleo o funciones públicas, remuneradas, ya sean nacionales, departamentales o municipales. La contravención a este mandato implica la suspensión del pago de la pensión por un tiempo igual al doble de aquel en que el pensionado haya ejercido el empleo; y si el pensionado hubiere cobrado a un mismo tiempo el sueldo y la pensión, quedara extinguida la pensión a perpetuidad.
