Se castigará con multa de veinte a doscientos, pesos, y prisión de uno a tres meses:

1.° Al que usare en sus artículos, productos o mercaderías, de una marca que sin ser falsificada ni imitada totalmente, por su simple apariencia o por sus inscripciones, combinación de colores u otras circunstancias, pueda inducir al público a error, concerniente al origen, calidad, cantidad, peso y procedencia de los dichos artículos, productos o mercaderías; y

2.° AI que a sabiendas venda, ofrezca en venta o de cualquier manera ponga en circulación artículos, productos o mercaderías, con marcas que tengan las irregularidades de que se trata en el artículo anterior.
