El Juez fija los términos cuando la ley no los ha señalado, y procura que no excedan de lo necesario para los fines consiguientes.

Los términos que señala el Juez son siempre de días o de horas, y prorrogables por justa causa, a juicio de él, alegada antes de su vencimiento.
