El juez o funcionario que no resuelva dentro de los términos legales alguna solicitud de excarcelación, incurrirá, sin perjuicio de las sanciones establecidas en el Código Penal, en la destitución del empleo que ejerza e interdicción del ejercicio de derechos y funciones públicas durante un año, sanciones que le serán impuestas por el superior respectivo, sumariamente, con la sola vista de la prueba de que se ha incurrido en la infracción.
