Si el juicio no se ha abierto a prueba, o se ha vencido el plazo de que trata el inciso primero del artículo anterior, el Juez ordena que se corra traslado al Fiscal y al defensor, para el estudio del expediente, hasta por el término de diez días a cada uno.
