La excepción de ilegimitidad de la personería ocurre en los casos siguientes:
Cuando el demandante no es hábil para comparecer en juicio por si mismo.
Respecto del apoderado y demás personas que gestionan a nombre de otras para que acrediten su representación; y
Para que se pruebe la identidad de la persona que establece la demanda.
