Sin necesidad de condenación expresa se tasarán costas a cargo del ejecutado en los casos siguientes:

1ºCuando no propongan excepciones;

2º Cuando proponga excepciones y se declaren en su totalidad no probadas; y

3º Cuando se causan con posterioridad a la sentencia en que se mande llevar adelante en parte la ejecución.

No obstante, cuando la ejecución se haya librado por cantidad estimada por el ejecutante en la demanda, no habrá costas si el ejecutado no opone más defensa que la regulación, y la pide antes de pasados tres días de intimada la ejecución y luego paga inmediatamente.
