Quedarán exentos de la pena señalada en losArtículos anteriores los que antes de toda intimación de la autoridad o de la fuerza pública, o inmediatamente después disolvieren la fuerza o impidieren que ésta cometa el delito para el cual había sido congregada.

También quedarán exentos de pena los que, sin haber intervenido en la formación de la fuerza, consientan antes de toda intimación o inmediatamente después, en retirarse sin resistencia y abandonen las armas.
