Si después de recibida al sindicado su declaración indagatoria y de practicar las diligencias que él indique, resultare desvanecida su culpabilidad, se le pondrá en libertad mediante la prestación de una promesa de honor, cuando el sindicado fuere Oficial, o de una fianza en los demás casos, mientras se decide del mérito del sumario.
