De la demanda para que se decrete la partición de bienes comunes, por cualquier causa, se dará traslado al demandado por tres días, con la prevención de que si no contesta se tendrán como probados los hechos de la demanda. No se decretará el traslado si el demandante necesitare licencia judicial para proceder a la partición, y no presentare comprobante de esa licencia.
