º El juez o empleado que hayan realizado turno de permanencia en jornada nocturna o en día festivo, tendrán derecho a un descanso compensatorio. El Juez y el empleado que hayan realizado turno de disponibilidad inmediata en jornada, nocturna o en día festivo y que efectivamente hayan tenido que laborar en ese período, tendrán derecho a un descanso compensatorio. Los directores seccionales de instrucción criminal, en las mismas resoluciones mediante las cuales organicen los turno de permanencia o de disponibilidad inmediata, establecerán los días en que tendrán lugar los descansos compensatorios, que en ningún caso serán acumulables.
