Las licencias a los Magistrados de los Tribunales, Jueces Superiores, de Circuito y de Menores, y a los Municipales para separarse del ejercicio de sus funciones, se conceden como lo dispone el Código Político y Municipal. El término de la licencia puede ser hasta de noventa días en el año, prorrogables por otros noventa en caso de enfermedad debidamente comprobada. A los Magistrados de la Corte Suprema de Justicia les concede licencia el Ministerio de Gobierno.
