Los Consejeros de Estado están sujetos a las prohibiciones establecidas en el artículo 105 de la Constitución Nacional para los miembros del Congreso. Este cargo inhabilita, además, a quien lo ejerce, para el desempeño de cualquier otro empleo público y para el ejercicio de la abogacía.

Tampoco podrán ser elegidos miembros del Congreso ni Diputados a las Asambleas Departamentales, sino tres meses después de haber cesado en el ejercicio de sus funciones.
