Art. 38. Cuando alguno de los que posean un terreno en común, solicite ante el Juez del Circuito la división y adjudicación del derecho que le corresponde, el Juez, dentro de las veinticuatro horas siguientes a la presentación de la solicitud, mandará que dicha división se efectúe y que todos los comuneros se presenten por sí o por apoderado, dentro de los sesenta días, y exhiban los títulos de propiedad que acrediten de un modo fehaciente el derecho que cada uno tenga en la propiedad común.
