Si el testador no determinare suficientemente el tiempo o la forma especial en que ha de cumplirse el modo, podrá el Juez determinarlos, consultando en lo posible la voluntad de aquel, i dejando al asignatario modal un beneficio que ascienda, por lo ménos, a la quinta parte del valor de la cosa asignada.
