Art. 240. Si el certificado resultare que la finca está gravada, el juez ordenará que se cite personalmente a los acreedores que tengan constituirá hipotecas en dicha finca, remplazándolos para que dentro de un término de prudencialmente fije, comparecerá hacer uso de su derecho en juicio de tercería.
