Cuando pueda concederse la condena condicional, pero hubiere fundado temor de que, en poder de las personas bajo cuyo cuidado esté el menor, no tenga éste el ambiente ni los elementos necesarios para su corrección o mejora, deberá el Juez, aplicarle la libertad vigilada con prescindencia de aquellas personas, y por un tiempo no menor de un año, ni que exceda del que le falte al menor para cumplir veinticinco.
