Art. 1.° Son fondos del Montepío Militar únicamente, aquellos de que tratan los números 1.°, 2.°, 3 °, 4.°, 8 ° y 9.° del artículo 2.° de la Ley 96 de 1890; y quedan, por tanto, excluídos los que señalaron los números 5.°, 6.° y 7.° del mismo artículo. Estos fondos constituyen el capital del Establecimiento y su producto serán los intereses de ese capital. Los sueldos y pensiones jamás gravarán éste pero sí lo afectarán las devoluciones de dinero de que se tratará luégo, cuando el producto fuere deficiente: en este caso, pagados los sueldos y gastos de administración el resto debe prorratearse entre los pensionados.
