Son delitos militares los que se cometen con infracción de las leyes militares, o en asuntos del servicio militar o dentro de los cuarteles, cuerpos de guardia, vivaques o buques de guerra y en general dentro de cualquiera dependencia militar. Los delitos o culpas cometidos fuera de estos casos serán juzgados como delitos comunes por la justicia ordinaria.
