El nombramiento de los Jueces de Menores se hará por el Tribunal Superior respectivo. Si este estuviere dividido en dos Salas, el nombramiento se hará por la Sala de lo Penal. Cuando existiere más de un Tribunal Superior en el territorio de un Departamento, corresponde el nombramiento de Juez de Menores al Tribunal, o a la Sala de lo Penal del Tribunal Superior que resida en la capital del Departamento.
