Son circunstancias de mayor peligrosidad, fuera de las consagradas en el Código Penal común y de las demás disposiciones que con ellas guarden analogía, las siguientes:

Cometer el delito en tiempo de guerra, conflicto armado, o turbación del orden público;

Cometer el delito delante de tropa formada;

Cometer el delito frente al enemigo, y

La mayor dignidad, grado, autoridad o mando del actor o del ofendido.
