Cuando el funcionario de instrucción reciba denuncio o cuando se encuentre en el caso previsto en el artículo anterior, expedirá un auto cabeza de proceso en que, fundándose en el conocimiento que ha tenido de la infracción penal, resolverá abrir la investigación correspondiente al descubrimiento de los hechos, de sus autores o participes, de la personalidad de los mismos, de los motivos determinantes y de la naturaleza y cuantía de los perjuicios.
