Al que de modo clandestino o fraudulento, elabore, distribuya, venda, o suministre, aun cuando sea gratuitamente, sustancias narcóticas, o las mantenga en su poder con los mismos fines, se le impondrá prisión de seis meses a cinco años y multa de cincuenta a mil pesos. La sanción se aumentará hasta en una tercera parte, si tales sustancias se suministran -o venden a menores de edad e a personas que habitualmente usaren de ellas.
