Cuando para perseguir una infracción se requiera la querella de parte, ésta sólo es necesaria para iniciar la acción penal; pero en el desarrollo de la investigación y del juicio, el funcionario de instrucción o el Juez procederán como si se tratara de una infracción que se persigue de oficio.
