Art. 43. cuando las posiciones se presentaren cerradas y hayan recibiesen fuera de lugar del juicio, lo que se verificara siempre que el absolvente no se encuentre en el, el juez de la causa abrirá el pliego para el único efecto de calificarles, y luego lo remitirá cerrado al juez. Esto no afecta el derecho el que tiene el que pide las posiciones para reclamar contra la resolución del Juez en que rechace alguna ò algunas de ellas, reclamación que puede hacer después de que sean absueltas y se le pacen en traslado.
